By accessing or using the Site, or by calling a telephone number displayed on the Site, you agree to these Terms of Use and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.

Eligibility

The Site is intended only for residents of the United States who are 18 years of age or older. By using the Site you represent that you meet these requirements and that the information you provide is your own.

No insurance advice; not the Marketplace

The Site provides general information and connects you with licensed insurance agents and agencies. It is not insurance, legal, tax, or financial advice, and it is not affiliated with or endorsed by any government agency, HealthCare.gov, or any federal or state Health Insurance Marketplace. Coverage decisions are between you and a licensed agent or carrier. You can review plans and enroll on your own at no cost at HealthCare.gov or your state Marketplace.

Contact consent

When you call a number on the Site, or provide your number to us or an agent, you consent to be contacted at that number by phone and text about health insurance, including by an automated telephone dialing system or prerecorded or artificial voice, at the number provided, even if it is on a Do Not Call list. Consent is not a condition of purchase. Message and data rates may apply. You may revoke consent at any time through our Do Not Contact page or by telling any agent to stop contacting you. Calls may be recorded or monitored where permitted by law.

Accurate information

You agree to provide accurate information and to use the Site only for your own lawful, personal purpose of seeking health coverage.

Intellectual property

All content on the Site is owned by us or our licensors and may not be copied or reused without permission.

No warranties

The Site is provided "as is" without warranties of any kind. We do not guarantee that any plan, price, savings, premium tax credit, or eligibility described or estimated will be available to you. Plan details and availability are set by carriers and government programs and can change.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any contact with an agent or carrier.

Third-party links

We are not responsible for the content or practices of websites we link to, including HealthCare.gov, or for the acts or omissions of any licensed insurance agent, agency, or carrier you are connected with through the Site.

Indemnification

You agree to indemnify and hold harmless GetACAQuotes and Voyant Digital Media Group, Inc., and its officers, employees, and agents, from any claim or demand arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

Binding arbitration; class action waiver

Please read this section carefully. It affects your legal rights. You and GetACAQuotes agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, the Privacy Policy, or any communications you receive from us or from a licensed agent connected to you through the Site, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

You and GetACAQuotes agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding. You and GetACAQuotes waive any right to a trial by jury.

If any portion of this section is found unenforceable, the remainder will remain in effect. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name, the phone number you used, and a clear statement that you opt out of arbitration.

Governing law

These Terms and any dispute between you and GetACAQuotes are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in Travis County, Texas will have exclusive jurisdiction and venue over any dispute not subject to arbitration, and you consent to personal jurisdiction there.

Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and GetACAQuotes regarding the Site and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes

We may change these Terms at any time by posting an updated version here with a new "Last Updated" date. Your continued use of the Site after changes are posted means you accept them.
